The officer found Kowalis, 54, in a car that appeared to have been trying to back into his driveway. The keys were in the ignition, in the on position, the gearshift was in reverse, but the engine was not running. The radio was on very loud. Kowalis was leaning to the right, and his feet were sticking out the driver’s door. He didn’t respond when the officer called out, but did after several taps on the leg.
In extremely slurred speech, Kowalis denied driving. The officer smelled strong odor of alcohol, and noticed Kowalis’ eyes were bloodshot and glassy. After first claiming to have been home all night, Kowalis admitted he’d “had a couple” at the Happy Valley tavern.
